NOTICE IS HEREBY GIVEN under Section 467 of the Local Government Act, that the Municipality of North Cowichan Council will consider first readings of “Zoning Amendment Bylaw No. 3913, 2023” and “Zoning Amendment Bylaw No. 3934, 2024” during their regular Council meeting to be held at 5:00 p.m. on Wednesday, March 6, 2024. Council is authorized under Section 135 of the Community Charter and Section 480 of the Local Government Act, to give the Bylaws up to three readings at this meeting. If the Bylaws are given third reading at this meeting, Council may adopt the Bylaws at that time.

NOTICE IS HEREBY GIVEN that Council is prohibited from holding Public Hearings for these Bylaws under Section 464 (3) of the Local Government Act.

The regular Council meeting, as authorized by Section 128 of the Community Charter, will be conducted by video conference using the Cisco Webex platform, and though electronic, is open to the public and anyone wishing to participate may do so in person by attending Council Chambers, or by joining the meeting using a computer, smartphone, or tablet. You may also view the meeting as it is streamed live by going to www.northcowichan.ca/Agendas and click on the ‘View Live Stream’ link. A copy of the recording will be made available after the meeting on North Cowichan’s website for on-demand viewing.

Zoning Amendment Bylaw No. 3913 (2524 Ashcroft Road, Chemainus)

The purpose of Zoning Amendment Bylaw No. 3913 is to amend Zoning Bylaw 1997, No. 2950, section 52 (4) (f) [Density in the Rural Zone (A2)] by adding the following subsection:

“(xxi) 2524 Ashcroft Road (PID: 000-677-311)”.

The amendment is to allow for a detached accessory dwelling unit on the subject property as shown outlined in bold on the map.

Zoning Amendment Bylaw No. 3934 (2999 Drinkwater Road, Duncan)

The purpose of Zoning Amendment Bylaw No. 3934 is to amend the following sections of Zoning Bylaw 1997, No. 2950 by inserting under:

• Section 43 “Drinkwater Road Multi-Family Comprehensive Development Zone (CD25)” to the end of the list of zones.

• Section 80.25 the new zone “Drinkwater Road Multi-Family Comprehensive Development Zone (CD25)”.

And to:

• Reclassify 2999 Drinkwater Road (PID: 003-887-669) from Residential Rural Zone (R1) to Drinkwater Multi-Family Residential Zone (CD25) and Public Use Zone (PU).

The amendment is to allow for the construction of a 6-storey apartment building (52 apartment units) and public park on the subject property as shown outlined in bold on the map.

The Bylaws can also be viewed in the Planning Department at the Municipal Hall, Monday to Friday (excluding statutory holidays) from February 20, 2024 to March 6, 2024, between 8:30 a.m. and 4:30 p.m. You may also request copies of the Bylaws by emailing planning@northcowichan.ca.

This notice is given as required by Section 467 of the Local Government Act.
